The offices of the District Attorney and City Attorney prosecute these types of cases all day. The Prosecutors know—and are willing to use against you—all of the fine legal points available to them.

The law says that the Prosecutor only needs to prove that, after drinking, you were not able to drive your car safely, or that your blood alcohol exceeded a certain limit. That sounds pretty cut and dried, but it’s not quite that simple.

You see, if challenged, the Prosecution has to show:

That the arresting officer made the arrest legally,
That you were properly advised of your rights,
That the equipment used to test you was working accurately,
That the person operating that equipment was certified to operate it.

If the Prosecution gets information that could prove you are innocent, an alert attorney can also make him/her give you that information.
